Plaintiff filed a personal injury lawsuit against a Hilton hotel after she was allegedly hit by a shuttle operated by Hilton. Although Hilton denied liability, mid-trial the parties settled for $85,000. The trial court confirmed Plaintiff's desire to accept the agreement on the record. Through different counsel, Plaintiff later filed a motion to rescind the settlement agreement, claiming counsel forced her to accept the agreement. According to Plaintiff, counsel stated that if she did not accept the settlement "he would not be coming back to trial tomorrow."The trial court denied Plaintiff's motion and the Second Appellate District affirmed. The court explained that Hilton was not involved in any potential duress, but was unaware of counsel's refusal to resume proceedings if Plaintiff did not accept the agreement. Daniel Schafer, a teacher at a high school in the Anderson Union High School District (District), had a sexual relationship on school premises with one of his students, plaintiff Jane Doe. Doe sued the District, principal Carol Germano, and superintendent Tim Azevedo for negligent hiring and negligent supervision. The trial court granted the District’s motion for summary judgment and entered judgment in favor of the District, finding that there was no evidence the District knew or should have known that Schafer posed a risk of harm to students. On appeal, Doe contended the trial court erred by granting summary judgment because the District had a duty to supervise and monitor Schafer and Doe, and whether the District breached its duty to Doe was a question of fact for the jury to decide. The Court of Appeal affirmed, finding that on the trial court record, the District did not have a duty to review alarm data and video recordings in order to constantly monitor all teachers, students, and campus visitors, nor did it have such a duty specifically with regard to Schafer and Doe. Plaintiff-appellant John Coates brought an action for breach of contract and breach of the duty of good faith and fair dealing against defendant-appellee Progressive Direct Insurance Company. Plaintiff was injured after a motorcycle collision; he was insured by Progressive under a motorcycle policy, an auto policy, and a policy providing UM coverage. Coates moved for partial summary judgment regarding his entitlement to uninsured/underinsured motorist benefits. Progressive moved for summary judgment regarding Coates' bad faith claim. Coates sought more time to conduct discovery to address Progressive's counterclaim on bad faith. The trial court granted Coates' Motion for Partial Summary Judgment, allowing his UM claim against Progressive. The trial court also granted Progressive's Motion for Summary Judgment, denying Coates' claim for breach of duty of good faith and fair dealing. The trial court denied Coates' Motion for Additional Time to Respond. After review of the parties’ arguments on appeal, the Oklahoma Supreme Court affirmed the trial court’s grant of partial summary judgment on Coates' UM claim. The Court reversed, however, the decisions granting Progressive's Motion for Summary Judgment and denying Coates additional time to respond to that motion. View "Coates v. Progressive Direct Ins. Plaintiff and his wife were passengers on a cruise aboard a ship operated by Defendant. A verbal altercation between Plaintiff and another passenger ensued and while the security officer turned to speak to Plaintiff, the other passenger punched Plaintiff in the face.   Plaintiff alleged that Defendant was negligent because it failed to (a) reasonably and properly train security personnel; (b) have adequate security measures, including adequate security presence and surveillance cameras; (c) warn him of the danger of being physically assaulted while onboard the vessel; (d) promulgate and enforce policies and procedures designed to prevent passengers from physically assaulting other passengers; and (e) exercise reasonable care under the circumstances. The district court granted summary judgment in favor of Defendant, ruling that there was no evidence suggesting that Defendant had actual or constructive notice of the risk of harm.   The Eleventh Circuit affirmed the grant of summary judgment to Defendant and denied Plaintiff’s motion for sanctions. The court held that Plaintiff has not presented sufficient evidence to create an issue of fact as to whether Defendant had actual notice that any passengers would attack him. The court reasoned that in the context of passenger-on-passenger violence, a cruise line has a duty to warn and/or protect when it or its employees reasonably apprehend the danger such that the attack was foreseeable. However, while the presence of a security officer during disembarkation connotes some awareness of the importance of order, a verbal dispute does not provide actual notice that a physical assault is to follow. Plaintiff filed a petition for damages in the 19th Judicial District Court in East Baton Rouge Parish. Plaintiff totaled his car in an accident and alleged that GoAuto, his car insurance carrier, paid less in policy benefits than his policy and Louisiana law required. GoAuto filed its notice of removal, Plaintiff received permission from the Louisiana court to amend his complaint again and, as accepted on appeal, filed the amended complaint. This amendment changed the definition of the class from class “residents of Louisiana” to class “citizens of Louisiana.” After removal, the parties filed several competing motions disputing which complaint controlled and the sufficiency of GoAuto’s notice of removal.   The Fifth Circuit affirmed the district court’s order remanding the case to state court, finding that Defendant is a citizen of Louisiana and thus the suit lacks the minimal diversity necessary to vest a federal court with jurisdiction. The court declined Defendant’s request to disregard the Louisiana state court’s pre-removal procedural rulings applying Louisiana law and substituted its own Erie guesses at how a Louisiana court ought to rule on a motion to amend a pleading.   Further, in regards to Defendant’s argument that it is plausible that some class members are not citizens of Louisiana, the court held that none of these individuals, assuming they had relocated to Colorado, Texas, or Florida before the filing of the complaint, qualify as citizens of Louisiana. Plaintiffs did not purchase flood insurance for their house after the sellers told them that the property was not in a FEMA flood zone. Within weeks the area flooded, the home was destroyed and Plaintiffs sued the property sellers, the Federal Emergency Management Agency, and private contractors.   Plaintiffs alleged that either FEMA or the Strategic Alliance for Risk Reduction (“STARR”) made the 2010 Change to the 100-year flood-line estimate and SFHA designation. They alleged that STARR is a joint venture by Defendants Stantec Consulting Services, Inc., Dewberry Engineers, Inc., and Atkins North America, Inc., but do not name STARR itself as a defendant. Atkins and Stantec filed a Motion to Dismiss under Federal Rule of Civil Procedure 12(b)(6), extending the federal-contractor defense. The district court granted the motion.   The Eighth Circuit affirmed the district court’s decision granting Defendant’s motion to dismiss. The court held that Plaintiffs fail to state a claim because their complaint does not contain sufficient factual matter to show they are entitled to relief from Defendants. The court reasoned that Plaintiff’s complaint does not state how Atkins, Stantec and Dewberry work within STARR or which entity was responsible for any acts through STARR. Further, the complaint fails to state a claim for negligent misrepresentation against Atkins, Dewberry, and Stantec because the Plaintiffs provide “only naked assertions devoid of further factual enhancement” for three elements. Finally, the complaint similarly failed to state a claim for fraudulent misrepresentation because it does not plead which defendant made what representation. View "Derek Christopherson v. After a 21-year career as a firefighter with the City of Pocatello, Richard Nelson was diagnosed with leukemia. Nelson brought a workers’ compensation claim against the City. The Industrial Commission determined that the City failed to rebut a statutory presumption of causation with substantial and competent evidence. The City appealed, arguing there was substantial evidence to rebut the presumption that Nelson’s cancer was caused by his employment. The City also argued Idaho Code section 72-438(14)(b) unconstitutionally discriminated between the employers of firefighters who had cancer and the employers of other employees who claim to have contracted an occupational disease. This case involved the definition of the term "impairment" in the context of Oregon's workers' compensation statutory scheme, and whether claimant Marisela Johnson’s loss of grip strength (that was determined to be caused in material part by an accepted, compensable condition and, in part, by a denied condition. Claimant contended that ORS 656.214 entitled an injured worker to compensation for the full measure of impairment due in material part to, and resulting in material part from, the compensable injury, including any impairment stemming from the denied condition, if applicable. SAIF Corporation disagreed, arguing that the definition of impairment did not include loss caused by a denied condition because it was not “due to” the “compensable industrial injury.” The Oregon Supreme Court concluded claimant was entitled to the full measure of her impairment. This litigation arose from a medical malpractice suit brought by plaintiffs, individually and on behalf of their minor daughter, against Dr. Daryl Elias, Jr. and his insurer. Plaintiffs alleged Dr. Elias committed malpractice during the child’s delivery, causing a separated right shoulder and a broken clavicle. Plaintiffs also alleged the child suffered permanent injury when the five nerve roots of her brachial plexus were completely and partially avulsed from the spinal cord, causing her to lose the use of her right arm. At the conclusion of trial, a jury returned a verdict in favor of defendants, finding the treatment provided by Dr. Elias to the child did not fall below the applicable standard of care for an obstetrician gynecologist. The Louisiana Supreme Court granted certiorari in this case for the primary purpose of addressing two narrow issues: (1) whether any errors in the district court’s evidentiary rulings interdicted the jury’s fact-finding process; and (2) if so, whether the court of appeal erred in reviewing the record de novo. The court of appeal found the district court committed prejudicial legal error in excluding the child's treating orthopedic surgeon, Dr. Kozin’s testimony in part and permitting defendant's retained expert, Dr. Grimm, to testify. The Supreme Court found no error in the judgment of the court of appeal insofar as it reversed the district court’s ruling limiting Dr. Kozin from testifying as to the cause of the child’s injuries: "a review of Dr. Kozin’s excluded testimony reveals he did not render any opinions on whether Dr. Elias breached the standard of care or was otherwise negligent. Rather, he simply testified as to the cause of the child’s injury, explaining that based on his expertise, he was 'certain the force applied by the delivering physician led to this injury.'" The district court erred in restricting his testimony. However, the Supreme Court concluded the district court did not abuse its great discretion in finding Dr. Grimm’s testimony was admissible under the standards set forth in La. Code Evid. art. 702 and Daubert/Foret. The court of appeal erred in reversing the district court’s evidentiary ruling. Furthermore, the Court held the court of appeal abused its discretion by undertaking a de novo review of the record rather than remanding the case for a new trial. In late 2017, someone sent anonymous letters containing personal and derogatory information about appellant Bryan Seale to his acquaintances. In December 2018, Seale discovered that someone had accessed his real estate business software account without authorization. Seale brought this action asserting claims against: (1) his ex-husband and ex-employee, Gary Peacock, for accessing his real estate business account without authorization; and (2) unnamed defendants for sending the anonymous letters. The magistrate judge dismissed the claims in two separate orders: (1) granting with prejudice Peacock’s motion to dismiss the claims alleged against him for failure to state a claim; and (2) denying Seale’s motion to amend the complaint to substitute Peacock for the unnamed defendants and dismissed the remaining claims without prejudice. Seale appealed both orders. The Tenth Circuit affirmed in part and reversed and remanded in part the magistrate court's order. Specifically, the Court affirmed dismissal of Seale’s Stored Communications Act (SCA) claim under Rule 12(b)(6). The Court affirmed the dismissal with prejudice of the statutory civil theft claim. The Court reversed and remanded the dismissal with prejudice of the SCA claim and the invasion of privacy by appropriation of name or likeness claim and instructed the magistrate court to dismiss these claims without prejudice.
